19-02-2021 Heard learned counsel for petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in Sadar Thana, Vaishali P.S. Case No. 182 of 2020 registered for the offence under Section 304(B)/34 of the Indian Penal Code. As per the prosecution case, the daughter of the informant was married with co-accused Vaibhav Anurag @ Rahul on 15-05-2019 and thereafter, it is alleged that all the accused persons, including these petitioners, tortured and harassed her (daughter of informant) for demand of dowry and due to non-fulfillment of the same, she was murdered by all the accused persons. It is further alleged that on 11-03-2020 at about 2:00 PM, the informant received a phone call that his daughter was unwell and when he reached the matrimonial
Patna High Court CR. MISC. No.24547 of 2020(5) dt.19-02-2021 2/2 home of his daughter to see his daughter, he saw that his daughter was laying dead and all the in-laws members had fled away from there.
It is submitted on behalf of petitioners that petitioners are father-in-law and mother-in-law of the deceased. There is general and omnibus allegation. Both petitioners are living separately and they have no concern with the affairs of the deceased. Petitioners are old aged persons. It is further submitted that husband of the deceased is already in custody. Considering the aforesaid facts and circumstances, the bail application of petitioners is allowed. In the event of their arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Vaishali in connection with Sadar Thana, Vaishali P.S. Case No. 182 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
