JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2018 The petitioners seek bail in anticipation of their arrest in connection with Giriyak P.S. Case No. 17 of 2018, dated 18.01.2018, instituted for the offences punishable under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code and Section 66 of the I.T. Act.
On secret information to the local police that some persons have congregated with forged and fabricated SIM cards, forged bank accounts and e-commerce register etc. for the purposes of alluring the villagers into investing
Patna High Court Cr.Misc. No.25199 of 2018 (2) dt.03-05-2018 2/2 money, a team was constituted and a raid was conducted. Four persons, viz. Gopi Kumar, Monu Kumar, Bablu Kumar and Gopal Kumar were arrested and certain incriminating articles were recovered from their possession. The names of the petitioners have transpired in the statement of the arrested persons. The petitioners do not have any criminal antecedent. But for the confession of the arrested accused persons, there is no other material against the petitioners to connect them with the offence. That apart, the offence remained inchoate and the attempt was thwarted by the local police.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif in connection with Giriyak P.S. Case No. 17 of 2018.
