02. In the present case, the petitioner seeks bail in connection with Kadamkuan P.S. Case No. 912 of 2024 registered for the alleged offences under Sections 103(1), 123 of Bharatiya Nyaya Sanhita, 2023.
03. As per prosecution case, petitioner was the husband of the daughter of the informant and allegation against the petitioner and other co-accused persons is of administering some poisonous substance to the daughter of the informant, who subsequently died.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Though FIR was initially registered under Sections 103(1)
Patna High Court CR. MISC. No.26450 of 2025(2) dt.06-05-2025 2/3 and 123 of BNS, but after investigation, the police submitted charge-sheet against the petitioner under Section 108 of BNS. Learned counsel further submits that some dispute arose between the petitioner and the deceased, who became furious on seeing inebriated condition of the petitioner, went in bathroom and consumed Harpic. The petitioner himself took her to the hospital, but she could not survive. Learned counsel further submits that the petitioner has otherwise not abetted the deceased for commission of suicide and there is no question of causing death of the informant by this petitioner. Learned counsel further submits that charge-sheet has been submitted and the custody of the petitioner is not required any more. The petitioner is in custody since 02.12.2024 and the petitioner is having clean antecedent.
05. Learned APP for the State opposes the prayer for bail. Learned APP submits that there is specific allegation against the petitioner for abetting the deceased for commission of suicide.
06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and his clean antecedent along with submission of charge-sheet, the petitioner above
Patna High Court CR. MISC. No.26450 of 2025(2) dt.06-05-2025 3/3 named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kadamkuan P.S. Case No. 912 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
