The petitioners, namely, Shahina Pervin and Dilshad Ahmed, apprehend their arrest in Kishanganj P.S. Case No. 311/2016 registered under Sections 419, 420, 409, 467, 468 of the Indian Penal Code.

The informant alleged that the petitioners were appointed as Handling Agent / Business Partner but the petitioners did not give any account of 299.30 metric tones of cement supplied by the company to the petitioner causing a loss of Rs. 42,18,326/- to the company.

Learned counsel for the petitioners submits that there is no misappropriation and the true facts came out on rendition of accounts. Learned counsel for the informant submits that now the

Patna High Court Cr.Misc. No.39392 of 2016 (4) dt.20-10-2016 2/2 dispute has already been settled amicably and the arrears have already been paid.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in Kishanganj P.S. Case No. 311/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
