The petitioners are apprehending arrest in connection with Kashim Bazar P.S. Case No. 299 of 2017 registered for the offence punishable under Sections 307, 427/34 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioners submits that the petitioners along with others have fired but no one has sustained any injury. The petitioners have no criminal antecedent as stated in paragraph-3. Learned counsel submits that in similar circumstance other co-accused have been granted anticipatory bail vide order dated 09.04.2017 passed in Criminal Miscellaneous No. 16541 of 2018 and vide order dated
Patna High Court Cr.Misc. No.25205 of 2018(2) dt.25-04-2018 2/2 12.04.2018 passed in Criminal Miscellaneous No. 15421 of 2018.
Considering the aforesaid, let the petitioners above named, be released in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Kashimbazar P.S. Case No. 299 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
