In this application for anticipatory bail the petitioner apprehends his arrest in connection with Mahila P.S. Case No. 13 of 2017 for the offences punishable under sections 448, 354 B, 376, 511 and 506 of the I.P.C.
Allegedly, the petitioner after removing cloths of the informant and being naked tried to commit rape with the informant and when the informant cried then the petitioner started fleeing away.
Submission is of false implication and that the petitioner is the Mahal Chaukidar posted at Turkauliya P.S, he has
Patna High Court Cr.Misc. No.50196 of 2017 (3) dt.18-01-2018 2/2 given Rs. 86,000/- in advance to the informant to execute the land and to grab that amount this false case has been lodged by the informant.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner by submitting that the informant in her further statement has supported the allegation during investigation also. Other witnesses has stated otherwise.
In the facts and circumstances stated above, considering the allegation attributed against the petitioner, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of C.J.M. East Champaran at Motihari.
