2. Lastly, prayer for bail of the petitioner was refused by this Court vide order dated 15.04.2022 . 3 . Trial court's report dated 11.09.2024 reflects that out of 13 charge-sheeted witnesses only six witnesses have been examined.

4. Learned counsel for the petitioner submits that petitioner has simply been made accused in this case only on the allegation that he was seen fleeing away from place of occurrence . No incriminating articles have been recovered from the possession of this petitioner. Petitioner is in custody since 29.04.2021 and claims clean antecedent.

5 . Considering the period of custody of the petitioner

Patna High Court CR. MISC. No.41619 of 2024(3) dt.18-10-2024 2/2 and the tardy progress of the trial, let the petitioner as named above be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge - X Bhojpur Ara arising out of NDPS Case No. 12 of 2020 (Udwant Nagar ) Police Station Case No. 202 of 2020.
