JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2016 The petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 494, 323, 504, 34 of the Indian Penal Code.

The basic accusation is of torture and performing second marriage.

It is submitted by learned counsel for the petitioner that petitioner admits his marriage with the informant and birth of a daughter.

It appears from the impugned order that at initially stage of hearing of bail application before learned Sessions Judge, it was submitted on behalf of the petitioner that petitioner is ready to keep the informant with dignity and honour, but on appearance of the informant the petitioner denied to keep the informant and her daughter or to make any

It is submitted by learned counsel for the petitioner that now the petitioner is ready to make payment of maintenance amount though not ready to keep the informant. In the circumstances, let learned Court below consider the prayer for bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Gaya Mahila P.S. Case No. 2 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Gaya. With the observations above, the application stands disposed of.
