This is a petition for grant of anticipatory bail for offence under Sections 175 and 120B of the Indian Penal Code and 7 of the Essential Commodities Act.
The Block Development Officer, Sonbarsa, Sitamarhi, seized wheat from the godown of this petitioner and alleges that the same was to be sold in the black market by the petitioner and that was meant for distribution to the needy people under Food Security Scheme.
Submission of the petitioner is that the petitioner is not a dealer of public distribution system nor there is material to substantiate as to from where wheat were brought. The petitioner has got no criminal antecedent.
Considering the aforesaid material, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sonbarsa P.S. Case No. 181 of 2016to the satisfaction of the
Patna High Court Cr.Misc. No.49400 of 2016 (2) dt.19-12-2016 Chief Judicial Magistrate, Sitamarhi, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
