Grievance of the petitioner in the instant case is that despite recommendation of the Commissioner Sub Divisional Officer, Sadar, Darbhanga has not passed appropriate order for removal of the encroachment over public road. Learned counsel for the petitioner admits that proceeding under Section 133 Cr.P.C. was initiated by the S.D.O., Darbhanga but the same is still pending.

Patna High Court CWJC No.9198 of 2019(2) dt.24-04-2019 2/2 Considering the fact that the proceeding was initiated in 2015 i.e. four years back, the Court directs S.D.O., Sadar Darbhanga to take final decision in the proceeding under Section 133 Cr.P.C. at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order, if order not already decided.

With the aforesaid, the writ petition stands disposed of.
