JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-06-2025 Heard learned counsel appearing on behalf of the petitioners, learned A.P.P. appearing on behalf of the State and learned counsel appearing on behalf of the informant/Opposite Party No. 2.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 74, 137(2), 62, 351(2), 351(3) and 3(5) of the B.N.S. and Section 12 of the POCSO Act.
3. As per prosecution case, these petitioners are alleged to have assaulted informant and tried to outrage the
Patna High Court CR. MISC. No.29483 of 2025(3) dt.24-06-2025 2/3 modesty of her daughter.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, both parties are close door neighbors and due to petty dispute, a quarrel took place between the parties leading to lodging of this false and concocted case. There is case and counter-case between the parties. It is further submitted that during pendency of this case, due to intervention of well-wishers of the parties, the matter has already been compromised and a joint compromise petition to that effect has been filed before the learned trial court, copy of which is Annexure-P/2 to this bail petition.
5. Learned counsel appearing on behalf of the informant/Opposite Party No. 2 does not dispute the contentions raised on behalf of the petitioner and confirms the fact regarding compromise between the parties.
6. Considering the general and omnibus nature of accusation and fact that dispute between the parties has already been compromised and old relations have been restored, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named
Patna High Court CR. MISC. No.29483 of 2025(3) dt.24-06-2025 3/3 petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO Act), Sitamarhi in connection with Bathnaha P.S. Case No. 527 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S..
