The Petitioner apprehends his arrest in Banka P.S. Case No.551 of 2016 instituted for the offence under Section(s) 406, 420/34 Indian Penal Code.
It is alleged in the written report of Civil Surgeoncum- Member Secretary, District Health Committee, Banka, that total seven firms were given supply order during 2011-13 and the price of goods were also given to them by Bank Draft for supply of such medicines, but all the firms either failed to supply or made part supply. Petitioner's firm is mentioned at serial no.6 and it is alleged that medicines worth `19,980/- were not supplied by him.

No.55685 of 2016 (3) dt.28-01-2017 2/2 During the course of argument, counsel for the petitioner submits that he has already deposited the amount i.e. `19,980/- by Bank Draft No.606104 dated 12.09.2016 and information has also been given to the Civil Surgeon-cum-Chief Medical Officer, Banka, vide letter dated 12.09.2016 (Annexure4). In such circumstances, since money has already been deposited by the petitioner, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Banka P.S. Case No.551 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, subject to the conditions as laid down under Section 438(2) Cr.
