The petitioner has prayed for grant of bail in connection with the case arising out of Motipur P.S. Case No. 936 of 2018 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25 (1-b)a, 26 and 35 of the Arms Act.

It is alleged that on vehicle checking by the police, three persons including the petitioner were apprehended and a loaded country made pistol was recovered from possession of the petitioner.

It is submitted by learned counsel for the petitioner that the allegations as stated in the FIR are false, he is in custody since 26.10.2018 and has no criminal antecedent. Having heard learned counsel for the parties and

No.26513 of 2019(4) dt.14-08-2019 2/2 taking into consideration the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West, Muzaffarpur in Tr. No. 3859 of 2019 arising out of Motipur P.S. Case No. 936 of 2018.
