JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-08-2024 The present petition has been filed for grant of anticipatory bail in connection with Deodha P.S. Case No. 111 of 2022, registered for the offences punishable under Sections 341, 323, 324, 354(B), 379, 307, 504, 506 and 509/34 of the Indian Penal Code.

At the outset, the learned counsel for the petitioner submits that the petitioner be granted liberty to surrender before the learned Court of Chief Judicial Magistrate, Madhubani in connection with Deodha P.S. Case No. 111 of 2022, within a period of four weeks from today, however, the learned Trial Court be directed to consider the bail petition to be filed by the petitioner and pass appropriate orders
Patna High Court CR. MISC. No.37209 of 2024(3) dt.30-08-2024 2/2 thereon on the very same day as also by considering the fact that subsequently the doctor of Sub Divisional Hospital, Jaynagar has opined that the injuries inflicted upon the injured Rajesh Banrait over left temporal region, attributable to the petitioner, has been found to be simple in nature. Liberty, so sought, is granted. 3.
It is needless to state that in case the petitioner surrenders before the learned Court of Chief Judicial Magistrate, Madhubani in connection with Deodha P.S. Case No. 111 of 2022, within a period of four weeks from today and files a petition for grant of regular bail, the learned Trial Court shall consider the same on merits and pass orders thereon on the very same day by also taking into account the fact that the injury, as aforesaid, has been subsequently found to be simple in nature by the doctor of Sub Divisional Hospital, Jaynagar.

The petition stands disposed off on the aforesaid terms.
