JUSTICE BIRENDRA KUMAR ORAL ORDER 03-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 379, 504 and 307 of the Indian Penal Code. On the order of this petitioner some other co-accused assaulted the informant with intent to commit murder. There is allegation of theft and commission of theft also. The occurrence, allegedly, took place on 18.05.2015 and the FIR has been lodged on 27.05.2015. There is case and counter case.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.46626 of 2016 (3) dt.03-03-2017 2/2 of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Darbhanga, In charge Jamalpur Police Station/Successor Court in connection with Jamalpur Police Station Case No. 68 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
