Mr. SRI JITENDRA KUMAR SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Chenari P. S. Case No. 120 of 2017 registered for the offences punishable under Sections 363, 364 of the Indian Penal Code. Allegedly, the petitioners kidnapped Puja Kumari the minor daughter of the informant and it is suspected that either they have sold her or they have killed her.

Submission is of false implication and that due to village politics the petitioners have been implicated, the petitioners are student of ITI, Varanasi and they were not present at the time of occurrence at that place. The victim girl has given her statement under Section 164 Cr.P.C. wherein she has not stated regarding her kidnapping. The certified copy of the statement recorded

Patna High Court Cr.Misc. No.49056 of 2017(3) dt.12-12-2017 2/2 under Section 164 Cr.P.C. of the victim girl has been filed which has been taken on record.

Learned APP submits that as per the statement of the victim girl, no offence as alleged is made out. In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Amit Raj, Additional Chief Judicial Magistrate-cum-Sub-Judge-3, Rohtas at Sasaram in connection with Chenari P. S. Case No. 120 of 2017, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
