The allegation against the petitioner is that he got some persons appeared on his behalf in the examination. It is submitted on behalf of the petitioner that the alleged person, who appeared on behalf of the petitioner, has already been granted bail by the court below itself and the petitioner has been falsely implicated in this case.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the court below and the court below will consider the aforesaid
Patna High Court Cr.Misc. No.48983 of 2016 (2) dt.19-12-2016 2/2 aspect of the matter as well as the fact that the person, who appeared on behalf of the petitioner, has already been granted bail by the court below and considering the above fact, he will dispose of the matter on its own merit without being prejudiced by the order of this Court.
