The petitioner seeks regular bail in connection with Marhowrah P.S. Case No. 293 of 2021 instituted for the offences under Sections 413 and 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 26.05.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that he had information that some small and big size iron gates are lying in the shop of the petitioner. Accordingly, the shop was raided and 12 pieces of iron gates weighing 200 kg were recovered which belonged to the closed

Patna High Court CR. MISC. No.37266 of 2021(2) dt.08-12-2021 2/2 sugar mill of Marhowrah.

Learned counsel for the petitioner submits that the petitioner is a shop owner and is engaged in business of selling and buying scraps. The petitioner was completely unaware that the aforesaid iron gates were stolen. It is further submitted that no businessman would bring disrepute to his business by indulging in such practice.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.05.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran in connection with Marhowrah P.S. Case No. 293 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
