1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that petitioner was posted at Blue Dart Centre and used to manage distribution of goods. Further, he did not deposit an amount of 1,30,000/- in the company's account and on inquiry, the petitioner confessed his guilt that he lost the money by playing online gambling (Rummy).

4. The learned counsel for the petitioner submits that

It is next submitted that the petitioner has already deposited an amount of Rs.30,000/-, as such, an amount of Rs.99387/- is required to be paid. The learned counsel for the petitioner submits that petitioner will deposit the said amount in the account of the company by 18.12.2023.

5. Learned A.P.P. opposes the bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on provisional bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Motihari, East Champaran in connection with Govindganj (Areraj O.P.) P. S. Case No.464 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.

8. However, it is made clear that if the petitioner does not submit receipt showing the deposit of Rs.99387/- in the account of the company on 18.12.2023, in that event, the learned trial Court shall forthwith cancel the bail bonds of the
