Learned counsel for the petitioner seeks permission to withdraw the present application filed on behalf of the petitioner for quashing the order dated 28.09.2022 whereby the learned Chief Judicial Magistrate, Purnea after accepting the final form on the ground on mistake of fact submitted by the police in connection with K. Nagar P.S. Case No. 68 of 2018 has directed to treat the Protest Petition as Complaint that to without assigning or recording any reason.
