Petitioner is apprehending his arrest in Sakra P.S.Case No.300 of 2016 registered for the offences under Sections 420, 409/34 of I.P.C.

Allegation against the petitioner and other accused persons is of defalcation of the government money to the tune of Rs.43,5,425.00(four lacs thirty five thousand four hundred twenty five) allotted for the plantation of the school. Submission of the learned counsel for the petitioner is that without having inquiry the present case has been lodged and thereafter order has been issued from the office of the District Rural Development Authority, Muzaffarpur, in which the amount has been released to all three accused including the petitioner

Patna High Court Cr.Misc. No.3829 of 2018 (3) dt.01-02-2018 2/2 proportionately. It has also been submitted that the petitioner is ready to deposit 1/3rd of the amount which is as per the order of the D.R.D.A.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with the direction that if the petitioner deposits 1/3rd of the total amount in the court below within a period of two months from today, he shall be released on bail to his own satisfaction. It is needless to say that the amount shall be deposited without prejudice to the petitioner and the same will be subject to the final result of the case.

With the aforesaid observation, this application is disposed of.
