The present application has been filed for quashing the First Information Report of Vibhutipur P.S. Case No. 106 of 2016 registered for the offences punishable under Sections 171(E) and 47(a) of Bihar Excise Amendment Act, 2016, pending in the court of learned ACJM-III, Rosera, Samastipur. Mr. Ambika Bhagat, learned counsel for the petitioners very fairly submits that the investigation has already concluded, though the charge sheet has been submitted under
Patna High Court Cr.Misc. No.38805 of 2016 (2) dt.19-04-2017 2/2 Sections 504 and 506 of the Indian Penal Code. In view of the fact that the investigation has already concluded, the prayer in the present application has become infructuous and accordingly, this application is disposed of with liberty to the petitioners to raise all the contentions at appropriate stage of the proceeding.
