====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-01-2021 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Sikandra P.S. Case No. 225 of 2019 for the offence under Sections 341, 323, 307, 379/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that there is no specific overt act as alleged against this petitioner and the allegation of assault is general and omnibus in nature. He further submits that as per F.I.R. the petitioner and his son assaulted the informant, which led to altercation. He also submits that other co-accused have been granted privilege of anticipatory bail by different Benches of this Court, as evident from Annexure-2 Series.
Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below
Patna High Court CR. MISC. No.28441 of 2020(2) dt.18-01-2021 2/2 within one month from the date of receipt of a copy of this order, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jamui in connection with Sikandra P.S. Case No. 225 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
