The petitioner is apprehending his arrest in a case registered under Sections 376, 315, 420 and 120B of the Indian Penal Code.
Allegation against the petitioner is that he established physical relationship with the informant on the promise of marriage and the petitioner had also taken Rs.35,000/- from the informant on the pretext of searching employment for him and later the informant came to know that petitioner had engaged with some other girl.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.45476 of 2017(2) dt.22-09-2017 2/2 petitioner has falsely been implicated in the present case. The present case has been instituted with an intention to blackmail the petitioner on the ground of getting married with him. Petitioner denies any physical relationship with the informant. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Patna in connection with Mahila Thana P.S. case No.50 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
