====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-12-2020 Heard the learned counsel for the parties.

The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 177 of 2019 (PR No. 50/19) instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that 1254.780 litres of liquor was recovered from a vehicle. The driver of the vehicle is alleged to have taken the name of the petitioner that the consignment was meant for him.

Learned counsel for the petitioner submits that the accusation is absolutely unfounded and wrong. In fact, other accused persons have been granted bail and the full brother of the petitioner under similar circumstances has been granted anticipatory bail.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Excise Case No. 177 of 2019 (PR No. 50/19), subject to the conditions as laid down under Section 438(2) Cr.P.C.
