2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 342, 327, 307, 385 , 504, 506 and 34 of the Indian Penal Code and 27 of Arms Act 3 . As per the prosecution case , on 31.12.2022 at about 5:30 O'Clock in the evening, all the F.I.R., named accused persons including this petitioner along with 20-25 unknown persons armed variously came over the land of informant, situated in Belaghat Madhepura and tried to make pressure on informant to execute sale deed in their favour and when informant refuse to do so then co-accused Manas Kumar ordered to kill the informant, upon which other co-accused
Patna High Court CR. MISC. No.29281 of 2025(2) dt.14-05-2025 2/3 persons started firing and brutally assaulted informant and others. Thereafter, all the accused persons fled away from the spot by firing in air.
4. Learned counsel for the petitioner submits that due to land dispute between the parties, this false and concocted case has been lodged against this petitioner. He further submits that petitioner is victim of the circumstances as petitioner is bonafide purchaser of land in question as one Manas Kumar executed sale deed in favour of this petitioner after payment of consideration amount. Case and counter case . The wife of petitioner Khusboo Devi also lodged Madhepura P S Case No. 02 of 2023 against informant and others. Petitioner claims clean antecedent. Similarly situated co-accused person has already granted bail by this Court vide order dated 21.08.2023 in Cr. Misc. No. 33698 of 2023 .
5 . Learned counsel for the State opposes the bail petition of the petitioner.

Considering the fact that similarly situated coaccused persons has already been granted bail, clean antecedent of this petitioner and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing

No.29281 of 2025(2) dt.14-05-2025 3/3 bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Madhepura in connection with Madhepura P.S. case No. 01 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
