In this case, the petitioner is apprehending his arrest in connection with Govindganj (Malahi) P.S. Case No. 88 of 2015 registered for offences under sections 406, 409 and 420 of the Indian Penal Code.
As per allegation made in the First Information Report, out of 34 millers, 33 millers have already deposited the money but, one miller failed to deposit which led to lodging of the present criminal case.
Learned counsel for the petitioner submits that it is he who has lodged the First Information Report against the
Patna High Court CR. MISC. No.29586 of 2019(2) dt.06-05-2019 2/2 miller but, during investigation, he has been made accused. Though it does not appear that the petitioner was involved in defalcation of the money but, he has failed to keep proper monitoring with regard to deposit of the C.M.R. Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Govindganj (Malahi) P.S. Case No. 88 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
