The petitioner seeks bail in Desari P.S. Case No. 30 of 2021, registered for the offence under Sections 307, 326, 34 of the Indian Penal Code and Section 27 of the Arms Act. As per the F.I.R., on 28.01.2021 at about 6:00 PM, while the son of the informant was sitting at the shop, two unknown miscreants came on motorcycle and caused fire-arm injury to the son of informant.

Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation and only material has come that on the instruction of petitioner, coaccused Monu Kumar caused fire-arm injury to informant's son. Petitioner is in custody since 20.03.2021. Chargesheet has been submitted.

Patna High Court CR. MISC. No.37591 of 2021(2) dt.06-01-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Desari P.S.
