JUSTICE MADHURESH PRASAD ORAL ORDER 26-09-2019 Petitioner has approached this court with a grievance that though there was specific guidelines and direction from the Directorate of ICDS, as is evident from Annexure 7 dated 27.2.2015 issued by District Programme Officer, Purnea, the petitioner has not been given letter selecting her as Anganwari Sevika for the center in question.

The respondents have placed on record their counter affidavit. It is their stand that every attempts were made to serve selection letter on the petitioner but the same could not be served. Counsel for the State further points out that accordingly on 20.3.2017 the CDPO

Patna High Court CWJC No.9796 of 2019(3) dt.26-09-2019 2/2 of B.Kothi had recommended to the District Programme Officer to cancel selection of the petitioner. Whether the same has been cancelled or not is still not known either to the petitioner or respondents. No such instruction is there in the pleadings on record. In the said circumstances, this Court considers it appropriate to direct the respondent authorities that if appointment of the petitioner as Anganwari Sevika has still not been cancelled till date then copy of the selection letter be handed over to the petitioner to facilitate her assumption of duty of Anganwari Sevika without any further delay. If the petitioner approaches the District Programme Officer Purnea within a week then selection letter should be handed over to her to facilitate her joining without further delay. In case the selection has been cancelled prior to today it will be open to the petitioner to assail the same before appropriate authority or by way of separate proceeding.

The writ petition stands disposed of with the aforesaid directions.
