Petitioner seeks bail in a case registered for the offences punishable under Sections 363 of I.P.C and later on 364(A),120(B) of I.P.C. has been added.

The FIR relates to missing of the son of the informant. The victim in his statement under Section 164 Cr.P.C. stated that one Chandan had taken him on a bike. Thereafter he came back and some unknown persons forcefully took him towards jungle. Those persons were Sher Singh and Vishal, who were identified due to calling of the accused persons by their name. Learned counsel for the petitioner submits that name of the petitioner does not surface in the statement of the victim boy nor the petitioner was put on T.I. Parade. He is in custody since 28.04.2019. Investigation of the case is already complete.

No.28130 of 2020(3) dt.25-01-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bounsi Police Station Case No.79 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
