The petitioners apprehend their arrest in connection with Sakara (Bariyarpur O.P.) P.S. Case No. 28 of 2017 instituted for the offences punishable under Sections 341, 323, 364/34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
It has been submitted that the name of this petitioner was disclosed by one of the co-accused Sudhir Kumar, who was apprehended by the villagers. The apprehended accused and two others allegedly picked up the informant and proceeded towards
Patna High Court Cr.Misc. No.50350 of 2017 (2) dt.31-10-2017 Bariyarpur and in the way the informant jumped from the tempo. It further appears that one country made pistol with three 9MM cartridges was recovered from the possession of the apprehended accused, who disclosed the name of these petitioners. There is no antecedent against these petitioners and except the disclosure of their names by the apprehended co-accused, there is nothing against these petitioners.
In the aforesaid facts and circumstances, the anticipatory bail prayer is allowed. The petitioners, above named, in the event of arrest / surrender within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-cum-Sub Judge 13th, Muzaffarpur in connection with Sakara (Bariyarpur O.P.) P.S. Case No. 28 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
