JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-03-2021 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Rajpur P.S. Case No. 34 of 2020 for the offences under Sections 147, 149, 341, 323, 325, 307, 504, 379, 427 of the Indian Penal Code.
It appears from the order dated 18.01.2021 that the application with regard to petitioner No. 1
Patna High Court CR. MISC. No.28431 of 2020(3) dt.15-03-2021 2/3 namely Satya Singh @ Satyendra Singh, son of Prasuram Singh has become infructuous, as he has been arrested during pendency of the present application. Learned counsel for the petitioners submits that petitioner No. 2 namely Satendra Singh @ Satendu Singh @ Satyendra Singh, son of Surendra Singh has also been arrested during the pendency of the present application. Hence, he seeks permission to withdraw the application with regard to petitioner No. 2.
Permission is accorded.
Accordingly, the application with regard to petitioner No. 2 namely Satendra Singh @ Satendu Singh @ Satyendra Singh, son of Surendra Singh is permitted to be withdrawn.
So far as petitioner Nos. 3 and 4 are concerned, learned counsel for the petitioners would submits that no overt act has been alleged against them. Moreover, there is case and counter case and the petitioner Nos. 3 and 4 are not having any criminal

Considering the fact that there is counter version of the occurrence, no overt act has been alleged and the petitioner Nos. 3 and 4 are not having any criminal antecedents, this Court is inclined to grant anticipatory bail to the petitioner Nos. 3 and 4. Let the petitioner Nos. 3 and 4, above named, in the event of their arrest or surrender within a period of four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Buxar in connection with Rajpur P.S. Case No. 34 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P. C. (Anil Kumar Upadhyay, J) Shageer/- U T
