Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Naubatpur P.S. Case No. 119 of 2023/ Spl. Case No. 384 of 2023 registered for the offence under Section 414, 420 of the Indian Penal Code and Sections 30(a), 32(ii)(iii), 36, 41(i)(ii) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 27.02.2023 and there is recovery of 147.750 litres of wine from his possession and he has clean antecedent.

Learned APP has vehemently opposed the prayer of bail.

Patna High Court CR. MISC. No.28266 of 2023(2) dt.15-05-2023 2/2 Considering the period of custody and recovery of liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Court, Excise, Danapur in connection with Naubatpur P.S. Case No. 119 of 2023/Spl. Case No. 384 of 2023.
