Petitioner has been rank dishonest in approaching the Court, which is now evident from the details of the conduct of the petitioner emerging from the
Patna High Court CWJC No.2278 of 2015 dt.21-04-2015 2 / 2 counter affidavit filed on behalf of the respondents.
2. When the petitioner's deed has been exposed that he has not only approached the High Court without clean hands but also suppressed vital facts in the pleadings, petitioner's counsel wants to withdraw the writ applications quietly without pushing the matter any further.
3. The Court in such circumstance generally is magnanimous but looking at the conduct of the petitioner, a simple prayer for withdrawal may not be called for in the given facts and circumstances because every litigant has to approach a court of law with certain amount of honesty and fairness.
4. Writ applications are permitted to be withdrawn but a cost of Rs.10,000/- is imposed upon the petitioner now and that amount will be paid to the Legal Services Committee of the Patna High Court within a period of six weeks from today. If that amount is not deposited by the petitioner, the District Programme Officer will deduct the above amount from any payable amount to the petitioner and deposit it with the Legal Services Committee of the Patna High Court.
5. Office will inform the Court about the deposit by the petitioner.
