JUSTICE SANJAY KUMAR ORAL ORDER 01-11-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends arrest in connection with Katra Police Station Case No. 51 of 2016 registered for the offences under sections 447, 341, 323, 225, 504/34 of the Indian Penal Code and section 25(1-b) (a), 26/35 of the Arms Act. It has been alleged that Shivam Kumar and Gaurav Kumar came to the son of informant and demanded mobile and on protest, they abused and assaulted him. On alarm, local people assembled and from the possession of the petitioner, one country made pistol was recovered.

The learned counsel for the petitioner submits that the petitioner has clean antecedent having no specific allegation. The other co-accused namely Shivam Kumar, Ram Shresth Singh and

Patna High Court Cr.Misc. No.50336 of 2017 (2) dt.01-11-2017 2/2 Amrendra Singh @ Awalendra Singh have been allowed bail by other coordinate Benches of this Court in Cr. Misc. Nos. 11746 of 2017 and Cr. Misc. No. 41737 of 2016. The fire arm was produced before the Police by the local people.

Considering the clean antecedent of the petitioner, facts and circumstances of the case, the prayer of anticipatory bail is allowed and the petitioner, Gaurav Kumar, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Muzaffarpur in connection with Katra Police Station Case No. 51 of 2016, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code.
