JUSTICE RAVI RANJAN ORAL ORDER 21-04-2015 A cheque of an amount of Rs. 20,64,800/- dated 18.4.2015 issued by the Collector, in favour of petitioner Dhananjaya Kumar has been produced by learned counsel for the State. Learned counsel for the petitioner receives that cheque. The concerned authorities has already under taken to allot the premises sought by the petitioner vide his letter dated 10.01.2014 and has already allotted 40,000 sq. feet of Gandhi Maidan in favour of the petitioner from 02.03.2015 to 15.04.2015 but the petitioner could not avail that in view of the fact that the authorities had expressed their inability to adjust the amount which was originally deposited by the petitioner for Disney Land
Patna High Court CWJC No.8308 of 2014 (8) dt.21-04-2015 2/2 Fair as now the space is sought to be allotted to Handloom, Handicraft Fair - cum - Entertainment Park. Thus, this Court has directed the State to refund the money deposited by the petitioner within two - three days which has now been refunded by aforesaid cheque. Under the aforesaid circumstances, the period for which the allotment was there, i.e., from 02.03.2015 to 15.04.2015 could not be utilized by the petitioner. It is also admitted position that the fair, which is already running there, has been given extension for 15 days. In such circumstance, let a fresh order of allotment in favour of the petitioner be issued by the competent authority in view of undertaking preferably for a period commencing from 30th April, 2015.
In the meantime, the petitioner has to deposit the entire requisite amount and should also complete all the formalities.
