JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-05-2018 The petitioners seek bail in anticipation of their arrest in connection with Bhabua P.S. Case No. 758 of 2017 dated 04.12.2017 instituted for the offences under Sections 147, 148, 149, 188, 332, 186, 353, 505, 341, 151, 152, 153A, 295A of the Indian Penal Code.
The petitioners are alleged to be the members of the mob which had collected at the Ekta Chauk and were raising slogans against the District Administration and others for one Rockey Raj @ Shivam Arya, accused of Bhabua P.S. Case No. 757 of 2017 of having posted objectionable materials against the muslim community.
There is no specific allegation against the petitioners.
Patna High Court Cr.Misc. No.25671 of 2018 (2) dt.04-05-2018 2/2 Under similar circumstances, some of the accused persons of this case have been granted anticipatory bail by a Bench of this Court; which order has been made part of this petition. The petitioners do not have any criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IVth, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 758 of 2017.
