The petitioner apprehends his arrest in Bhabua P.S. Case No.588 of 2019 registered under Sections 147, 148, 149, 160, 337, 338, 333, 353, 307 and 427 of the Indian Penal Code. It is alleged that one Sahil Rine is said to have killed a person by firing and thereafter many persons assembled on the place of occurrence and started assaulting Sahil Rine but the police somehow saved Sahil Rine and brought him to hospital for treatment but the mob came to hospital and tried to snatch Sahil Rine from the hospital in order to assault and kill him. The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and there is no material that the petitioner assaulted anybody. It appears from para 3 of the bail petition that the petitioner is accused in another case

Patna High Court CR. MISC. No.28151 of 2020(3) dt.12-01-2021 2/2 bearing Bhabua Case No.591 of 2019.

Taking into consideration the fact that petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. If the petitioner surrenders in the court below, learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced by the order of this Court.
