Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 354, 506, 379 and 302 read with Section 34 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Specific allegation of assault on the head of the deceased is against co-accused Shravan Das and Bucho Das. There is no allegation of committing overt act against these petitioners and they are alleged to have instigated other accused

Patna High Court CR. MISC. No.28006 of 2022(2) dt.26-09-2022 2/2 persons to assault the victim. There is case and counter case. Police after investigation submitted final form against the petitioners. Petitioners have got no criminal antecedent. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Madhepura Bharrahi OP Police Station Case No. 407 of 2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
