The petitioner seeks bail in Suryagadha P. S. Case No. 228 of 2018 instituted for the offence under Section(s) 302/394/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for petitioner submits that petitioner is not named in the written report. He has been made accused during investigation because he is brother of one of the named accused person, namely, Sukesh Singh.

In the written report, there is allegation that total six named accused persons and 3-4 unknown accused persons surrounded the Chimni Bhattha of the informant and started

Five lakhs as Rangdari for which the informant had showed her inability. In the meantime, her devar Vipin Yadav arrived at the place of occurrence thereafter on the orders of Neeraj Singh and other Bhikhari Singh made firing on the head of brother-in-law of the informant on account of which her brother -in-law died on the spot.

In this manner, there is no allegation of specific overt act against this petitioner in the written report.. Petitioner is in custody since 22.11.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Lakhisarai in connection with Suryagadha P. S. Case No. 228 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
