JUSTICE SANJAY KUMAR ORAL ORDER 13-11-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend arrest in connection with Rampur Chauram Police Station Case No. 31 of 2017 registered for the offences under sections 323, 341, 324, 307, 447, 504 and 380/34 of the Indian Penal Code.
The allegation, as per written report, is that altogether 9 F.I.R. named persons armed with deadly weapon, came at the place of informant and started altercation. Thereafter, scuffle took place and both the sides sustained injury. For the said occurrence, a Police case, vide Rampur Chauram P.S. Case No. 32 of 2017 was also registered for the offences under sections 341, 323, 324,
Patna High Court Cr.Misc. No.53470 of 2017 (2) dt.13-11-2017 2/2 307 and 504/34 of the Indian Penal Code on the written report of Ram Shewak Singh, (father of petitioner no. 1). From the written report of both FIRs. it appears that both the parties are agnates and land dispute is going on since long between them. The allegation of assault and taking articles from the possession of the petitioners appears omnibus.
Considering the nature of allegation, facts and circumstances of the case, the prayer of anticipatory bail is allowed and the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Rampur Chauram Police Station Case No. 31 of 2017, subject to the condition as laid down under section 438 (2) of the Criminal Procedure Code.
