JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Barahiya P.S. Case No. 95 of 2016 registered for the offence punishable under sections 341, 323, 307/34 of the Indian Penal Code to which section 302 IPC was added later on.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to village politics. Nothing specific has been alleged against this petitioner. Allegations levelled are general and omnibus against all the F.I.R. named accused persons including this petitioner. Moreover, the injured Siyaram Singh has sustained only one injury and there is no injury report with respect to others. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the

No.51657 of 2017(3) dt.14-12-2017 2/2 submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P.S. Case No. 95 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
