2. The petitioners apprehend their arrest in connection with Masaurhi P.S. Case No. 40 of 2021 registered under Section 30(a) of Bihar Excise Act.
3. As per prosecution case, 60 liters illicit liquor has been recovered from Khalihan.
4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case merely on suspicion. Further submission is that nothing has been recovered from the conscious possession of the petitioners. Petitioners have no
Patna High Court CR. MISC. No.33481 of 2024(3) dt.05-07-2024 2/2 concern with the alleged recovery. Petitioners are an old men and have not got criminal antecedent of similar nature.
5. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Masaurhi P.S. Case No. 40 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
