Petitioner seeks bail in Rosera P.S. Case No.14 of 2019 instituted for the offence under Section(s) 47/ 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that petitioner is not named in the First Information Report.

It is alleged that one Truck was intercepted by the police and total 4758 litres foreign liquor was recovered. One Vijay Kumar was found sitting in the cabin of Truck. He disclosed that aforesaid consignment was brought by him for Pintu Kumar @ Prabhat Kumar, Neeraj Mahto and Swayamvar Yadav. Name of the petitioner has transpired during

Patna High Court CR. MISC. No.27558 of 2019(2) dt.29-04-2019 2/2 investigation as his mobile number was found in the mobile phone of Vijay Kumar.

Petitioner is in custody since 03.03.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise, Samastipur, in connection with Rosera P.S.
