SINHA) 20-07-2015 The plaintiff-respondent of Title Appeal Nos. 31 of 1989 and 51 of 1989 has filed this appeal assailing the order dated 24.07.2012 passed in C.W.J.C. No. 1509 of 2007 whereunder the learned single Judge has refused to entertain the said writ petition praying, interalia, to allow the plaintiff-respondent to use the land beyond 7 decimal which has been decreed in his favour on the ground that cross appeal filed by him is pending to be heard alongwith the aforesaid two appeals.
We do not find any reason to interfere with the
Patna High Court LPA No.1628 of 2012 (3) dt.20-07-2015 2/2 aforesaid order dated 24.07.2012 but would like to direct the District Judge, Bihar Sharif to ensure disposal of the aforesaid Title Appeal Nos. 31 of 1989 and 51 of 1989 and the cross appeal filed by the appellant herein as early as possible preferably within a period of two months from the date of receipt/production of a copy of this order and submit report to this Court.
