JUSTICE BIRENDRA KUMAR ORAL ORDER 28-01-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363/366A of the Indian Penal Code.
Allegation is that the petitioners and co-accused Nishant Kumar Singh kidnapped the minor daughter of the informant, namely, Sabana Khatoon.
Submission of the petitioner is that case-diary would reveal that the witnesses have stated that the matter was of loveaffairs and co-accused Nishant has fled away with Sabana Khatoon. Since the petitioners are the family members of Nishant
Patna High Court Cr.Misc. No.51270 of 2016 (4) dt.28-01-2017 2/2 Kumar Singh, hence, they are suspected.
Considering the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Mrs. Divya Shekhar, Judicial Magistrate, 1st Class, Saran at Chapra/Successor Court in connection with Sahajitpur Police Station Case No.49 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
