JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2018 Heard learned counsels for the petitioners and State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 379 and 411 of the IPC.

The prosecution case is that one tractor loaded with sand, parked near the petroleum dealership, was seized, but none came to claim the same. The petitioners are the owner and driver of the tractor in question.

It is submitted by learned counsel for the petitioners that case has not been registered under the provision of Mines Act. The petitioners do not claim the sand in question, nor any one has claimed that the sand was stolen. A statement has been

Considering the nature of accusation, coupled with the statement made in paragraph no.3 of the petition, that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned C.J.M., Banka in connection with Rajoun P.S.
