The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 354, 504, 427, 379/34 of the Indian Penal Code and Section 3 (i) (x) of SC/ST Act.
It is contended that it is apparent from the FIR itself that in view of the earlier dispute regarding keeping the Scooti in front of the house, there was some altercation between the parties and due to which, the petitioners have falsely implicated in this case. It is further contended that there is delay in lodging the FIR and it
Patna High Court Cr.Misc. No.58462 of 2015 (2) dt.01-02-2016 2/2 does not appear from the FIR that there was any insult in public view.
Having regard to the facts and circumstances of the case, let the petitioners, namely, Rako Kumar, Bittu Kumar, Rinku Kumar and Manish Prasad @ Manish Kumar be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Chowk P.S. Case No.71/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, Patna subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
