The petitioners seek bail in anticipation of their arrest in connection with Parsa Bazar P.S. Case No. 133/2017 dated 06.07.2017 instituted for the offences under Sections 341, 342, 323, 325, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioners has submitted that though the petitioners have been named in the F.I.R., but the allegation against them and others are of general and omnibus nature.

It has been alleged that the informant while coming back home, was surrounded and assaulted by Lathi, Danda and iron rod.

Patna High Court Cr.Misc. No.4278 of 2018 (2) dt.01-02-2018 2/2 One of the accused persons of this case, having similar allegation against him, has been granted anticipatory bail by order dated 17.10.2017 passed in Cr. Misc. No. 500014/2017. This Court has also taken note of the fact that the F.I.R. has been lodged after 10 days of the occurrence. Petitioner nos. 2 and 3 do not have any criminal antecedent, whereas petitioner no. 1 was made accused in an excise case, in which he is on bail.

Considering the aforesaid facts, the petitioners above named are directed to be released on bail, in the event of their surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to their furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Patna in connection with Parsa Bazar P.S. Case No. 133/2017.
