The petitioner seeks direction by filing this PIL to remove the encroachment from public land bearing R.S. Khata No.436, R.S. Plots No.1031 and 1749, measuring 3.54 acres and 90 decimals situated in village Khajuri, P.S. Tekari, District Gaya.
After some argument, learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to file petition before the Circle Officer (Collector under
4/4 the Bihar Public Land Encroachment Act, 1956) for removal of the encroachment from the public land.
If such petition is filed, the Circle Officer shall pass order in accordance with law within four months from the date of receipt of such petition affording reasonable opportunity to the petitioner for hearing.
With the aforesaid observation, the writ petition is disposed of as withdrawn.
